1. Agreement to Terms

By accessing or using Tech Craft Limited's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

All services are provided on an as-agreed basis through written contracts, proposals, or service agreements.

3. Client Responsibilities

3.1 Information Accuracy

Clients must provide accurate, complete, and timely information required for project execution. Any delays caused by incomplete or inaccurate information may affect project timelines and costs.

3.2 Cooperation

Clients agree to cooperate with Tech Craft Limited staff, provide timely feedback, and make necessary decisions within agreed timeframes to ensure successful project completion.

3.3 Payment Terms

Clients must adhere to payment schedules outlined in service agreements. Late payments may result in project suspension or additional fees as specified in individual contracts.

4. Intellectual Property Rights

4.1 Client-Owned Materials

Clients retain ownership of all materials, content, and intellectual property provided to Tech Craft Limited for project execution.

4.2 Deliverables

Upon full payment, clients receive ownership rights to the final deliverables as specified in the service agreement. Tech Craft Limited retains the right to use project work samples for portfolio and marketing purposes unless otherwise agreed in writing.

4.3 Proprietary Tools

Tech Craft Limited retains ownership of all proprietary tools, frameworks, and methodologies used in service delivery.

5. Confidentiality

Tech Craft Limited commits to maintaining the confidentiality of all client information, business data, and proprietary materials. We will not disclose confidential information to third parties without explicit written consent, except where required by law.

This confidentiality obligation continues even after project completion or termination of services.

6. Warranties and Disclaimers

6.1 Service Quality

Tech Craft Limited warrants that all services will be performed with professional care and expertise consistent with industry standards.

6.2 No Guarantees

While we strive for excellence, Tech Craft Limited does not guarantee specific business results, revenue increases, or market outcomes from our services. Software and systems are provided "as developed" with industry-standard testing and quality assurance.

6.3 Third-Party Services

We are not responsible for the performance, availability, or security of third-party services, platforms, or tools integrated into our solutions.

7. Limitation of Liability

Tech Craft Limited's liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages including but not limited to:

• Loss of profits or revenue
• Loss of data or business information
• Business interruption
• Loss of business opportunity

This limitation applies regardless of the legal theory of liability.

8. Project Changes and Scope

Any changes to agreed project scope, timeline, or deliverables must be documented through formal change requests. Additional work beyond the original scope may result in adjusted fees and timelines.

Both parties agree to document scope changes in writing before implementation.

9. Termination

9.1 Termination by Client

Clients may terminate services with written notice. Payment for work completed up to the termination date is required, and no refunds will be provided for services already rendered.

9.2 Termination by Tech Craft Limited

We reserve the right to terminate services if the client breaches these terms, fails to make timely payments, or engages in conduct that we reasonably believe to be harmful or illegal.

10. Governing Law

These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of Kenyan courts.

11. Amendments

Tech Craft Limited reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

For active projects, existing service agreements will continue under the terms agreed at project commencement unless both parties agree to amendments.
